Terms of Service

Last updated: September 24, 2026

Welcome to AsAP (Assessment Analytics Platform), referred to in these Terms of Service as "AsAP," "the Service," "we," "us," or "our."

AsAP is an independently developed and operated assessment analytics platform created by Darwin D. Macawile (the "Developer"). AsAP provides tools for assessment checking, OMR-based answer processing, item analysis, Table of Specifications (TOS) generation, learner assessment records, and related assessment-support features.

AsAP is an independent educational technology innovation. It is not an official system of, affiliated with, sponsored by, authorized by, or endorsed by the Department of Education (DepEd), the Schools Division of Eastern Samar, or any other government agency, unless expressly stated otherwise in writing.

By creating an account, accessing, or using AsAP, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you should not use the Service. If you are using AsAP on behalf of a school, organization, or institution, you confirm that you have the authority to accept these Terms on its behalf.

1. The Service

AsAP provides digital tools intended to assist teachers and educational institutions with assessment-related tasks, including, but not limited to:

  • scanning and processing assessment answer sheets;
  • detecting learner responses through OMR and related technologies;
  • generating assessment scores and results;
  • generating item analysis and related statistics;
  • generating Tables of Specifications and competency-related summaries;
  • organizing assessment records for temporary storage and export;
  • generating suggested intervention or enrichment activities through AI-assisted features; and
  • providing other assessment-related features that may be introduced or modified over time.

AsAP is an assistive tool. It does not replace the professional judgment, verification, or responsibility of teachers, school personnel, or other authorized users. Users should review assessment results, generated reports, and AI-generated content before using them for official records, instructional decisions, reporting, or other purposes.

2. Eligibility and Account Registration

To use AsAP, you must provide information that is accurate and reasonably complete during registration.

You are responsible for:

  • maintaining the confidentiality of your account credentials;
  • preventing unauthorized access to your account;
  • ensuring that information associated with your account remains reasonably accurate; and
  • all activity conducted through your account.

You must not:

  • impersonate another person or organization;
  • create an account using false or misleading information;
  • share account credentials in a manner that compromises account security;
  • use another person's account without authorization; or
  • attempt to obtain unauthorized access to another account or the Service.

If you are registering or using AsAP on behalf of a school or institution, you are responsible for ensuring that you have the necessary authority to do so.

3. School and Institutional Accounts

Schools and institutions may use AsAP to provide access to authorized teachers or personnel.

The school or institution is responsible for:

  • determining which individuals are authorized to access its account;
  • managing access among its personnel;
  • ensuring that its users comply with applicable school, institutional, and government policies;
  • ensuring that it has the appropriate authority to upload and process learner information; and
  • reviewing and managing records exported from the Service.

AsAP does not determine whether a school or teacher has obtained all permissions required under applicable laws, regulations, or institutional policies before uploading learner information.

4. Learner and Assessment Information

Users may upload or process learner assessment information through AsAP, including learner names, answer-sheet information, assessment responses, scores, competency-related information, and generated assessment results.

Users are responsible for ensuring that they have the lawful authority and necessary permissions to submit such information to the Service. Users must not upload information that they are not authorized to process or disclose.

AsAP does not claim ownership of learner or school assessment data submitted by users. The applicable school, institution, teacher, or other authorized user retains its rights and interests in such information, subject to applicable law. The processing of personal information through AsAP is further described in the AsAP Privacy Policy, which forms part of the Service's terms governing use of the platform.

5. Data Retention and Deletion

AsAP is designed to provide temporary storage of learner assessment records. Unless otherwise expressly stated for a particular feature, learner assessment records saved to the AsAP application database are automatically deleted after three (3) days.

This may include:

  • learner names;
  • saved assessment results;
  • generated learner outputs;
  • saved assessment-related records; and
  • saved Table of Specifications or competency information stored as part of the assessment record.

Once records are deleted under the applicable retention policy, they may not be recoverable. Users are responsible for downloading, exporting, printing, or otherwise retaining any records they need before the applicable deletion period expires.

AsAP is not intended to serve as a permanent archive or official records repository unless a specific feature expressly states otherwise. Certain technical logs, backups, security records, or other limited information may be retained for periods necessary for security, system recovery, legal compliance, or other legitimate purposes, subject to the applicable Privacy Policy and law.

6. AI-Assisted Features

AsAP may provide AI-assisted features that generate suggested intervention, enrichment, or other assessment-related content based on information supplied through the Service. AI-generated content is provided as an assistive suggestion only.

AI-generated outputs may contain inaccuracies, omissions, inappropriate recommendations, or content that does not fully correspond to the intended competency, grade level, curriculum requirement, or classroom context. Users must independently review and evaluate AI-generated content before using it with learners or incorporating it into official instructional or assessment materials.

The teacher or authorized educational professional remains responsible for determining whether generated content is appropriate for actual use. AsAP does not represent that AI-generated content is automatically approved, certified, or officially issued by DepEd or any other educational authority.

7. Assessment and OMR Accuracy

AsAP uses automated technologies to process answer sheets and generate assessment results. Automated processing, including OMR or mark detection, may occasionally produce incorrect results because of factors such as image quality, lighting, paper condition, scanning or camera quality, markings, printing variations, or other technical circumstances.

Users are responsible for reviewing results and correcting errors before relying on them for official records, grading, reporting, or instructional decisions. AsAP should not be treated as the sole authority for determining a learner's official academic record.

8. Acceptable Use

You agree to use AsAP only for lawful and legitimate purposes. You must not:

  • use AsAP for unlawful activities;
  • upload information that you are not authorized to process;
  • attempt to access another user's account or data;
  • bypass authentication or authorization controls;
  • circumvent subscription, usage, or feature restrictions;
  • probe, scan, test, or exploit security vulnerabilities without authorization;
  • interfere with or disrupt the Service;
  • introduce malicious code, harmful files, or other malicious content;
  • scrape, copy, harvest, or systematically extract information from the Service;
  • reverse-engineer, decompile, disassemble, or attempt to obtain the source code of AsAP, except where expressly permitted by applicable law;
  • reproduce, resell, sublicense, or commercially exploit the Service without written authorization;
  • use automated systems to abuse or overload the Service;
  • misrepresent AsAP-generated results as officially certified or verified when they have not been independently reviewed; or
  • use the Service in a manner that violates applicable law or the rights of others.

We may restrict, suspend, or terminate access where we reasonably believe that these restrictions have been violated.

9. Subscriptions, Payments, and Billing

Certain features of AsAP may require a paid subscription or other payment. Applicable prices, feature limits, and subscription periods will be presented through the Service or during checkout. Payments may be processed by third-party payment providers, including PayMongo. AsAP does not directly store users' complete payment-card information.

Unless expressly stated otherwise:

  • subscriptions do not automatically renew;
  • no recurring subscription charge will be made after the purchased subscription period ends;
  • the account may return to the applicable Free tier after the paid period expires; and
  • fees already paid are generally non-refundable except where a refund is required by applicable law or expressly provided by AsAP.

For school or institutional accounts, the account holder is responsible for determining how access is allocated among its authorized users. We may change pricing or subscription features in the future. Material changes will be communicated through reasonable means where appropriate.

10. Free and Paid Features

AsAP may offer Free, Pro, Pro School, or other plans. Features, limits, usage allowances, storage, processing capabilities, and other benefits may differ between plans. We may introduce, modify, limit, or discontinue particular features or plan benefits. Attempting to bypass technical or subscription restrictions, including through multiple accounts or other unauthorized methods, is prohibited.

11. Intellectual Property

AsAP and its components are owned by, or licensed to, the Developer and/or applicable rights holders. This includes, where applicable:

  • source code;
  • software architecture;
  • algorithms and processing methods;
  • OMR and assessment-processing technologies;
  • system workflows;
  • database structures;
  • user-interface designs;
  • graphics and branding;
  • logos, names, and trademarks;
  • documentation;
  • proprietary prompts and AI workflows;
  • reports and system-generated layouts; and
  • other proprietary elements of the Service.

Your use of AsAP does not transfer ownership of any part of the Service to you. You may not copy, reproduce, modify, distribute, sell, sublicense, publish, or create derivative works from AsAP or its proprietary components without prior written authorization, except where such activity is expressly permitted by applicable law.

12. User Content and Assessment Materials

You retain your rights to assessment questions, answer keys, instructional materials, and other content that you independently upload to AsAP, subject to the rights of third parties. By uploading content, you confirm that you have the necessary rights or authorization to use that content with the Service.

You grant AsAP the limited permission necessary to process, store, transmit, and display your uploaded content solely for the purpose of providing the requested Service and its associated functions. AsAP does not acquire ownership of your uploaded assessment materials merely because you use the Service.

13. Service Availability and Changes

We make reasonable efforts to keep AsAP available and functioning properly. However, uninterrupted or error-free operation cannot be guaranteed. The Service may occasionally be unavailable or affected by:

  • maintenance;
  • updates;
  • technical failures;
  • hosting or infrastructure issues;
  • third-party service interruptions;
  • internet or network problems;
  • security incidents; or
  • circumstances outside our reasonable control.

We may modify, improve, replace, suspend, or discontinue features of AsAP as the Service develops.

14. Third-Party Services

AsAP may rely on third-party services or infrastructure to provide certain functions, including hosting, authentication, database services, payment processing, AI services, analytics, communications, or other technical services. The availability or operation of third-party services may affect corresponding AsAP features. Third-party services may have their own terms and privacy policies, which may apply to the user's interaction with those services.

15. Security

We implement reasonable technical and organizational measures intended to protect the Service and information processed through it. However, no online system can be guaranteed to be completely secure. Users are responsible for maintaining the security of their own devices, credentials, and access to the Service.

If you become aware of unauthorized access, suspected account compromise, or a security vulnerability affecting your account or use of AsAP, you should report it through the official AsAP contact channel.

16. Disclaimer of Warranties

To the extent permitted by applicable law, AsAP is provided on an "as is" and "as available" basis. We do not guarantee that:

  • the Service will always be available;
  • the Service will always be error-free;
  • OMR or automated assessment results will always be accurate;
  • AI-generated content will always be accurate or appropriate;
  • generated reports will always be free from errors; or
  • the Service will satisfy every particular institutional or instructional requirement.

Users remain responsible for independently verifying information and results before using them for official, academic, administrative, or instructional purposes.

17. Limitation of Liability

To the extent permitted by applicable law, the Developer will not be liable for indirect, incidental, consequential, special, or similar damages arising from or related to the use of, or inability to use, AsAP. This may include, where legally permitted, losses resulting from:

  • incorrect automated assessment results;
  • reliance on AI-generated content;
  • temporary Service interruptions;
  • loss of data resulting from the stated retention and deletion policy;
  • user errors;
  • unauthorized access caused by compromised user credentials; or
  • third-party service failures.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable Philippine law.

18. Account Suspension and Termination

You may stop using AsAP and request closure of your account at any time. We may suspend or terminate an account where we reasonably determine that:

  • these Terms have been violated;
  • the Service is being abused or misused;
  • unauthorized access or security threats are suspected;
  • fraudulent activity is suspected;
  • continued access creates a legal, security, or operational risk; or
  • required by applicable law or a lawful order.

Where reasonably practicable, we may provide notice before suspension or termination. However, immediate action may be taken when necessary to protect the Service, users, or other parties. Termination does not restore information already deleted under the applicable data-retention policy.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, applicable requirements, or our operating practices. When material changes are made, we may provide notice through the Service or another reasonable method and update the "Last updated" date. Your continued use of AsAP after the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

20. Privacy

Your use of AsAP is also subject to the AsAP Privacy Policy, which explains how personal information is collected, used, stored, disclosed, and protected. The Privacy Policy forms part of the terms governing your use of the Service. Where applicable, the Privacy Policy also explains the rights available to individuals whose personal information is processed through AsAP and how privacy-related inquiries may be submitted.

21. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the use of AsAP shall be subject to the jurisdiction of the appropriate courts of the Philippines, subject to applicable law.

22. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

23. Entire Agreement

These Terms, together with the applicable Privacy Policy and any other terms expressly incorporated into the Service, constitute the agreement between you and AsAP regarding your use of the Service. If a specific feature has additional terms presented at the time of use or purchase, those terms will apply to that feature to the extent stated.

24. Contact

For questions, concerns, account matters, privacy inquiries, or reports concerning the Service, users may contact AsAP through the official contact information provided within the Service.

Privacy Policy

Last updated: September 24, 2026

This Privacy Policy explains how AsAP (Assessment Analytics Platform) ("AsAP," "the Service," "we," "us," or "our") collects, uses, stores, protects, and processes information in connection with the Service.

AsAP is independently developed and operated by Darwin D. Macawile (the "Developer"). AsAP is an independent educational technology innovation and is not an official system of, affiliated with, sponsored by, authorized by, or endorsed by the Department of Education (DepEd), the Schools Division of Eastern Samar, or any other government agency, unless expressly stated otherwise in writing.

This Privacy Policy applies to information processed through AsAP and should be read together with the AsAP Terms of Service.

1. Information We Collect

Depending on how you use AsAP, we may process the following information.

1.1 Account Information

When you create or use an AsAP account, we may collect information such as:

  • name;
  • email address;
  • school or institution information;
  • subject, grade level, or other information you provide for use of the Service;
  • account and authentication information; and
  • information associated with your use of AsAP.

We only request information reasonably necessary to provide and manage the Service.

1.2 Learner and Assessment Information

AsAP may process learner information submitted by authorized teachers or educational institutions, including:

  • learner name;
  • assessment responses;
  • scanned or photographed answer sheets;
  • assessment scores;
  • item analysis results;
  • competency-related information;
  • Table of Specifications information;
  • generated assessment reports; and
  • other assessment information submitted or generated through the Service.

AsAP does not intentionally require or collect Learner Reference Numbers (LRNs) or other government-issued or institutional learner identification numbers as part of its standard assessment workflow. Users must not upload personal information that they are not authorized to process through the Service.

1.3 Payment Information

Paid features may be processed through third-party payment providers such as PayMongo. AsAP does not directly collect or store users' complete payment-card details. Payment providers may process payment information according to their own privacy policies and applicable requirements.

1.4 Technical and Usage Information

As necessary to operate and secure the Service, AsAP or its service providers may process limited technical information such as:

  • IP address;
  • browser or device information;
  • login and access records;
  • error or diagnostic information; and
  • security-related logs.

The specific technical information collected may depend on the infrastructure and services used to operate AsAP.

2. How We Use Information

We process information for purposes reasonably necessary to operate, maintain, secure, and improve AsAP, including:

  • creating and managing user accounts;
  • authenticating users;
  • processing and checking assessment answer sheets;
  • generating assessment scores;
  • generating item analysis;
  • generating Tables of Specifications and competency-related summaries;
  • temporarily storing assessment records;
  • providing exports and reports;
  • providing AI-assisted intervention or enrichment features;
  • processing subscriptions and payments;
  • preventing unauthorized access, abuse, fraud, and security incidents;
  • troubleshooting technical problems;
  • communicating with users about the Service; and
  • complying with applicable legal obligations.

We do not use learner assessment information for unrelated advertising purposes.

3. AI-Assisted Processing

AsAP may provide AI-assisted features that generate suggested intervention, enrichment, or other assessment-related activities. When a user requests an AI-generated output, information necessary to generate that output may be transmitted to a third-party AI service provider. Where technically practicable, AsAP is designed to provide the AI service with only the information necessary for generating the requested output.

AI processing may involve information such as:

  • grade level;
  • subject;
  • competency or learning competency;
  • assessment performance;
  • number or nature of incorrect responses; and
  • other assessment-related information necessary to generate the requested activity.

Users should not intentionally include unnecessary personal information in information submitted for AI processing. AI-generated outputs are not treated as authoritative academic records or official educational directives. Teachers and authorized educational personnel remain responsible for reviewing AI-generated content before using it with learners. Third-party AI providers may process information according to their own terms and privacy practices. AsAP will use reasonable measures appropriate to the Service to limit information transmitted to such providers.

4. Purpose and Basis of Processing

AsAP processes information only for legitimate and reasonably necessary purposes connected with providing the Service. Depending on the circumstances, processing may be based on:

  • the user's request to provide a particular Service;
  • the user's agreement to the Terms of Service;
  • compliance with applicable legal obligations;
  • legitimate purposes necessary to maintain and secure the Service; or
  • another lawful basis available under applicable data protection law.

For learner information, the teacher, school, or institution using AsAP is responsible for determining whether it has the appropriate authority or lawful basis to submit that information to the Service.

5. School and Teacher Responsibility

Teachers, schools, and institutions using AsAP remain responsible for ensuring that they are authorized to submit learner information to the Service. This includes responsibility for:

  • obtaining any required permissions or authorizations;
  • following applicable school or institutional policies;
  • submitting only information necessary for the intended assessment purpose; and
  • handling exported or downloaded records appropriately.

AsAP is designed to process submitted information for the purposes of providing its assessment-related functions and does not determine whether a particular school or teacher has obtained all permissions required by their institution or applicable law.

6. Data Retention

AsAP is designed around short-term retention of learner assessment records. Unless otherwise stated for a particular feature, learner assessment records stored in the AsAP application database are automatically deleted after three (3) days from the time they are saved.

This may include:

  • learner names;
  • assessment results;
  • generated learner outputs;
  • assessment-related records; and
  • saved Table of Specifications or competency information associated with the assessment.

Users may also delete eligible records manually before the automatic deletion period. Once an application record has been deleted under the retention policy, it may not be recoverable. Users are responsible for downloading, exporting, or printing records they need to retain before the applicable retention period expires.

Limited technical logs, security records, backups, or other information may remain for longer periods where reasonably necessary for security, system recovery, troubleshooting, legal compliance, or other legitimate purposes, subject to applicable law.

7. Account Retention

Account information may be retained for as long as an account remains active or as otherwise necessary to provide the Service. When an account is closed, we may delete or anonymize account information within a reasonable period, subject to:

  • legal or regulatory requirements;
  • legitimate security requirements;
  • dispute resolution;
  • fraud prevention;
  • system records that cannot reasonably be removed immediately; or
  • other lawful purposes.

Account closure does not restore learner or assessment records that have already been deleted under the applicable retention policy.

8. Who May Process Information

Information processed through AsAP may be accessible to or processed by:

  • the authorized user associated with the account;
  • authorized school or institutional users where applicable;
  • the Developer or authorized personnel responsible for operating and maintaining AsAP;
  • hosting, database, authentication, storage, security, and infrastructure providers;
  • payment providers such as PayMongo;
  • AI service providers when an AI-assisted feature is used; and
  • other service providers reasonably necessary to operate the Service.

We do not sell learner assessment information to advertisers. We do not intentionally disclose learner information to unrelated third parties for their independent marketing purposes. Third-party service providers may process information on our behalf or as necessary to provide their services and may be subject to their own terms and privacy policies.

9. Data Security

We implement reasonable technical and organizational measures intended to protect information processed through AsAP. These measures may include:

  • access controls;
  • authentication mechanisms;
  • encrypted connections;
  • restricted database access;
  • security monitoring and logging;
  • limited data retention; and
  • other safeguards appropriate to the nature of the Service and information processed.

No internet-based system can be guaranteed to be completely secure. Users are also responsible for protecting their account credentials, devices, and access to the Service. If you believe that your account or information may have been accessed without authorization, you should contact us promptly.

10. Data Breaches and Security Incidents

If AsAP becomes aware of a personal data breach or security incident involving information processed through the Service, we will take reasonable steps to investigate, contain, and address the incident. Where notification is required by applicable law or regulation, we will provide the required notifications to the appropriate parties and authorities within the applicable period.

11. Your Rights

Subject to applicable Philippine law and any lawful limitations, individuals whose personal information is processed through AsAP may have rights including:

  • the right to be informed about the processing of their personal information;
  • the right to access applicable personal information;
  • the right to request correction of inaccurate information;
  • the right to object to certain processing;
  • the right to request deletion or blocking where legally applicable;
  • the right to data portability where applicable;
  • the right to lodge a complaint with the appropriate data protection authority; and
  • other rights provided under applicable data protection laws and regulations.

Requests concerning learner information should generally be coordinated with the teacher, school, or institution that submitted the information, where that party is responsible for determining the purpose and authority for the processing. Requests concerning an AsAP account or information directly controlled by AsAP may be submitted through our official contact information below. We may need to verify the identity or authority of a person making a request before providing access to or modifying information.

12. User Choices

Users may:

  • review available account information;
  • delete eligible learner records through the Service;
  • export or download records before the applicable retention period expires;
  • close their account; and
  • contact us regarding privacy-related questions or requests.

Because learner records are subject to the three-day retention policy, users should not rely on AsAP as a permanent records repository.

13. Cookies and Similar Technologies

AsAP may use cookies, local storage, session technologies, or similar mechanisms necessary for authentication, security, functionality, and user preferences. Where applicable, additional technologies may be used for service performance, diagnostics, or analytics. The specific technologies used may change as the Service develops.

14. Children and Learner Information

AsAP is designed primarily for use by teachers, schools, and educational personnel rather than for direct registration by learners. Learner information may nevertheless be processed when submitted by an authorized teacher or educational institution for legitimate educational and assessment purposes.

AsAP does not intentionally create learner accounts as part of its standard teacher assessment workflow. Users should not create accounts for learners or submit learner information outside the intended functions of the Service.

15. Third-Party Services

AsAP relies on certain third-party services to operate portions of the platform. These may include providers for:

  • hosting and infrastructure;
  • databases and storage;
  • authentication;
  • payment processing;
  • AI services; and
  • other technical functions.

These providers may have their own privacy policies and terms governing their services. Where appropriate, users should review the applicable third-party policies for information about their own processing practices.

16. International Processing

Some third-party service providers used by AsAP may process or store information outside the Philippines. Where this occurs, processing will be subject to the applicable contractual, technical, organizational, and legal safeguards appropriate to the service and information involved.

17. Privacy Policy Changes

We may update this Privacy Policy from time to time to reflect changes in the Service, technologies used by AsAP, data-processing practices, applicable laws or regulations, or other operational requirements. When changes are made, we will update the "Last updated" date. Where appropriate, material changes may also be communicated through the Service or other reasonable means.

Your continued use of AsAP after the effective date of an updated Privacy Policy constitutes acceptance of the updated policy to the extent permitted by applicable law.

18. Contact Us

For questions, concerns, privacy requests, or inquiries regarding the processing of personal information through AsAP, you may contact:

When submitting a privacy request, please provide enough information for us to understand and appropriately respond to the request. We may request reasonable verification where necessary to protect personal information from unauthorized disclosure.

19. Applicable Law

This Privacy Policy is intended to operate in accordance with applicable laws and regulations of the Republic of the Philippines, including applicable Philippine data protection requirements. Where a provision of this Privacy Policy conflicts with a mandatory legal requirement, the applicable legal requirement will prevail.
